Welcome to Studio Bazaar. These Terms & Conditions (the "Terms") govern your use of our website at www.studiobazaar.co.uk (the "Website") and your purchase of products from us. By accessing our Website or making a purchase, you agree to be bound by these Terms. Please read them carefully.

2. Products

2.1 Nature of Products: We specialise in sourcing and selling vintage, antique, and pre-owned decorative objects, predominantly framed as wall art. Due to their age and historical nature, our products are sold "as is" and will inherently show signs of wear, age, and imperfections. These characteristics are part of their unique appeal and are not considered defects.

2.2 Product Descriptions: We endeavour to describe and display our products as accurately as possible, including dimensions, materials, and condition. However, colours may vary slightly depending on your monitor settings. All dimensions are approximate.

2.3 Photography: We use professional photography to represent our items. Photographs form part of the product description. Please examine all images carefully.

2.4 Authenticity: While we conduct due diligence in sourcing our items, given the historical nature, we cannot always provide definitive provenance. We describe items to the best of our knowledge and expertise.

 

3. Pricing & Payment

3.1 Prices: All prices are displayed in Great British Pounds (£). VAT is currently not applicable. We reserve the right to change prices at any time without prior notice. The price charged will be the price displayed at the time of your order.

3.3 Payment Security: We do not store your credit card details. All transactions are handled by secure third-party payment gateways.

3.4 Currency: All transactions are processed in GBP (£). Your bank may apply conversion fees if you are paying from a different currency.

 

4. Orders

4.1 Order Acceptance: Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us. We will confirm our acceptance upon completion of payment. We will then send you an email confirming that the product has been dispatched (the "Dispatch Confirmation"). The contract between us will only be formed when we send you the Dispatch Confirmation.

4.2 Stock Availability: All products are subject to availability. As many of our items are unique, once sold, they may not be restocked. If an item you have ordered is unavailable, we will inform you as soon as possible and offer a full refund.

4.3 Cancellation by Us: We reserve the right to cancel an order if: a) The product is out of stock. b) We identify a pricing or product description error. c) Payment is not authorised. d) We are unable to deliver to your location.

5. Shipping & Delivery

5.1 Delivery Locations: We ship globally (restrictions may apply).

5.2 Delivery Times: We aim to dispatch orders within 5 business days of receiving cleared payment. Estimated delivery times can be negotiated with you the consumer (e.g., express delivery). These are estimates, and actual delivery times may vary.

5.3 Shipping Costs: Shipping costs are calculated at checkout based on the size, weight, and destination of your order.

5.4 Customs & Duties: For international orders, any customs duties, taxes, or import fees are the sole responsibility of the buyer. We are not responsible for delays caused by customs processing.

5.5 Risk: The risk of loss and damage to products passes to you upon delivery.

5.6 Delivery Issues: If your order does not arrive within the estimated timeframe, please contact us immediately. We will investigate with the courier.

 

6. Returns, Refunds & Cancellations

6.1 Your Right to Cancel: As a UK consumer, you have the right to cancel your contract with us and receive a refund if you notify us within 14 days of receiving your order.

6.2 Exercising Your Right to Cancel: To cancel, you must clearly inform us by email at sales@studiobazaar.co.uk within the 14-day period.

6.3 Returning Products After Cancellation: If you cancel, you must return the product(s) to us within 14 days of notifying us of your cancellation. a) Products must be returned in the same condition in which you received them, carefully repackaged to prevent damage during transit. b) You are responsible for the direct cost of returning the goods. We recommend using a tracked and insured shipping service, as we cannot be responsible for items lost or damaged in return transit. c) The return address is: [Your Return Address].

6.4 Refunds After Cancellation: We will process your refund within 14 days of receiving the returned goods, or if earlier, within 14 days of you providing proof that you have returned the goods. The refund will include the original cost of the product(s) and the original delivery charge (if applicable).

6.5 Damaged or Faulty Items: a) If a product arrives damaged or is faulty, you must notify us within 48 hours of delivery by email, providing clear photographs of the damage/fault and the packaging. b) We will arrange for a return or replacement, or offer a full refund, depending on the circumstances and product availability. In such cases, we will cover the cost of return shipping.

7. Website Use

7.1 Access: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Website for personal, non-commercial purposes.

7.2 Prohibited Use: You must not use our Website in any way that causes, or may cause, damage to the Website or impairment of the availability or accessibility of the Website; or in any way which is unlawful, illegal, fraudulent or harmful.

7.3 Intellectual Property: All content on this Website, including text, graphics, logos, images, and software, is the property of Studio Bazaar or its content suppliers and is protected by UK and international copyright laws. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website without our express written permission.

 

8. Limitation of Liability

8.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

8.2 To the fullest extent permitted by law, Studio Bazaar will not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Website or products purchased.

8.3 Our total liability to you for any loss or damage arising in connection with these Terms or any product purchase shall be limited to the total price of the product(s) you purchased.

 

9. Data Protection & Privacy

9.1 We are committed to protecting your privacy. We collect, use, and store your personal data in accordance with GDPR and other UK data protection laws. By using our Website, you consent to such processing and you warrant that all data provided by you is accurate.

10. General

10.1 Severability: If any part of these Terms is found to be unenforceable, the remainder of the Terms shall remain in full force and effect.

10.2 Waiver: Any failure by us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

10.3 Entire Agreement: These Terms, together with our Privacy Policy and any product-specific disclaimers, constitute the entire agreement between you and Studio Bazaar concerning your use of the Website and purchase of products.

10.4 Governing Law & Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of England and Wales. You agree that any dispute arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
